1. The highest bidder of each lot shall be the purchaser thereof. If any dispute arises as to the highest bidder, the Auctioneer shall determine the dispute and may put up again and re-sell the lot in respect of which the dispute arises.

2. (a) The bidding and advances shall be regulated by and at the discretion of the Auctioneer.

(b) Where an agent purchases on behalf of an undisclosed client such agent shall be personally liable for payment of the purchase price to the Auctioneer and for safe delivery of the lot to the said client.

3. (a) The Auctioneer reserves the right to bid on behalf of the clients and vendors, but shall not be liable for errors or omissions in executing instructions to bid.

(b) The Auctioneer reserves the right before or during the sale to group together lots belonging to the same vendor, or split up and/or withdraw any lot or lots.

4. Each lot shall be at purchaser’s risk from fall of hammer and must be taken away at his or her expense by a purchaser.

(a) If attending Sale, payment before leaving room unless previously agreed..

(b) United Kingdom, within Five working days on receipt of pro forma invoice.

(c) Overseas, within seven working days of receipt of pro forma invoice.

On no account will lots be despatched or delivered before payment unless previously agreed. If any purchaser fails to pay in full for any lot within the said time such lot may at the Auctioneer’s discretion be put up for Auction again or sold privately; if upon such a re-sale a lower price is obtained for such a lot than was obtained on the first sale the difference in price and expense of such a re-sale shall be made good by (and debt due from) the purchaser in default upon the first sale.

5. The Auctioneer shall not be liable for any default of the purchaser or vendor.

6. (a) Unless otherwise indicated each lot is sold as genuine and properly described.

(b) If after the sale the purchaser of the lot shall prove it to be not genuine or wrongly described the purchaser shall be at liberty to reject the lot provided he or she (i) being within the United Kingdom within seven days or being overseas within a reasonable time of the date of the sale gives notice in writing to the Auctioneer of intention to question as the case may be the genuineness or description of the lot, AND (ii) within thirty days of the sale (or in exceptional cases such time as may be in the Auctioneer’s discretion be allowed for expertising) returns such lot to the Auctioneer. NOTE: The onus of proving a lot to be not genuine or wrongly described lies with the purchaser. Proof of the inability of an Expert Committee to express opinion will not discharge such onus.

(c) Lots stated to contain collections and/or undescribed stamps must be taken with all faults and errors as to numbers (if any), and by reason of the foregoing a purchaser of any such lot shall have no right to reject the same.

CONDITIONS OF SALE

1. There will be a Buyers Premium of 15% which will be charged in addition to the hammer price on all lots sold.

2. Care is taken to ensure that any statement as to authorship, attributions, date, age, provenance and conditions is reliable and accurate but all such statements are statements of opinion and are not to be taken as statements or representations of fact. The auctioneers disclaim any liability for themselves or the Vendor for any errors of description.

3. The highest bidder shall be the buyer, subject to any reserves. If any dispute arises the Auctioneer shall have absolute discretion to settle it or to put any disputed lot up again.

4. The auctioneer has the absolute right to divide and join lots, he may refuse any bid, withdraw lots from sale and advance the bidding as he may decide.

5. All lots are sold as seen with all faults and imperfections. Neither the auctioneers nor the vendor are liable for any faults or defects . Each bidder must satisfy themselves by inspection or otherwise as to the condition and description of the lot including any damage, repairs or restoration. No warranty whatever is given by the auctioneers or Vendor to any buyer
in respect of any lot.

6. In bidding the buyer acknowledges that he has satisfied himself with the conditions of sale and agrees to be bound by them.

7. All lots must be paid for in full and removed at the buyer’s expense and risk from the saleroom by the end of the sale day. In default of this the auctioneers shall not be responsible if the same are lost, stolen, damaged or destroyed. All lots not removed within this period shall be at the sole risk of the buyer and subject to a storage charge. If items are not removed after the expiration of 14 days after the conclusion of the sale they may then be sold either publicly or by private treaty without any notice to the buyer.

8. The buyer will be liable for any losses or charges as a result of non-compliance with any of the conditions of sale.

9. All buyers must register and obtain a bidding number before bidding. They must give details of their full name, address and contact telephone numbers.

10. Payment can be made by cash, debit card or credit card. Credit cards will be subject to a 3 %

11. The Auctioneers will be pleased to execute commission bids on behalf of those unable to attend the sale. The lot will be purchased for the lowest bid possible subject to reserves and other bidding. Bids given over the telephone, late bids, or bids for members of staff to execute are accepted at the buyers risk.

12. Every person whilst on the premise before, during or after the Sale shall be deemed to be there at their own risk, and no person shall make or have any claim against the Vendor or the Auctioneer in respect of any injury he may sustain, or accident which may happen

13. Every person whilst on the premises will be held responsible for any damages they cause to the premises or to any Lots at any and all times

14. Every bidder will be deemed to act as principal unless there is a written agreement with the Auctioneers in force prior to the Auction that the bidder acts as agents on behalf of a named principal

15. Online Bidding

Football Sport Auctions Limited offers an online bidding service via the-saleroom.com for bidders who cannot attend the sale.
In completing the bidder registration on www.the-saleroom.com and providing your credit card details and unless alternative arrangements are agreed with Football Sport Auctions Limited:
1. authorise Football Sport Auctions Limited, if they so wish, to charge the credit card given in part or full payment, including all fees, for items successfully purchased in the auction via the-saleroom.com, and
2. confirm that you are authorised to provide these credit card details to Football Sport Auctions Limited through www.the-saleroom.com and agree that Football Sport Auctions Limited are entitled to ship the goods to the card holder name and card holder address provided in fulfilment of the sale.
Please note that any lots purchased via the-saleroom.com live auction service will be subject to an additional 3% commission charge at the rate imposed on the hammer price

NOTICE TO VENDORS

1. Each lot received for sale is subject to the Conditions of Sale, and unless the contrary is expressed in writing by the intending vendor each lot is RESERVED AT THE ESTIMATED VALUE. Written instructions as to reserves (if any) must reach us at the latest on the day before the date of the sale and must be confirmed after receipt by marked Catalogue.

2. The Vendor shall state any reserve in Sterling.

3. On any occasion of the Vendor requesting to withdraw any lot from sale, the Vendor is liable to pay the auctioneer 50% of the reserve price quoted on the companies Vendor Statement for each individual lot.
